Terms and Conditions
Last updated: Oct 30, 2026
These terms describe the service as it works today.
1. Agreement to terms
By using Kestly (the website, the iPhone and Android apps and the services behind them) you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the service.
Kestly is provided by Cave Sight (ABN 48 587 662 266), a sole trader business.
If the business that provides Kestly changes, we will tell users.
2. What Kestly is
Kestly helps Australian sole traders keep a GPS mileage logbook, save receipts and expenses, and create tax invoices with GST. It is a record-keeping tool. It does not lodge your BAS with the ATO, give personal tax advice, or handle payroll.
The plans are Free, Logbook, Pro and Teams. What each plan includes and its limits are on the pricing page. The price is the one shown at checkout. New users get 30 days of Pro with no card needed, and the account then moves to the Free plan unless you buy a plan.
3. Your account
You sign in with a one-time code sent to your email address. You are responsible for:
- a Teams Owner is responsible for who they add to their team, and for checking that person is allowed to drive and to use the service for the business;
- keeping your email account secure;
- everything that happens under your account;
- telling us straight away if someone uses your account without permission;
- keeping the details you enter correct.
4. Plans, trial and payments
Paid plans will be sold on our website when they launch; the iPhone and Android apps do not take payments. Paid plans will be subscriptions that renew each month or each year until you cancel. Payment is taken by our payment provider and the price you see at checkout is the price you pay.
Kestly is provided by Cave Sight, which is not registered for GST. No GST is added to our prices, so the price you see is the price you pay. We do not issue tax invoices. Our payment provider, Stripe, creates a payment receipt for each successful payment. If Cave Sight registers for GST in the future, we will say so on this page and tell you before any price or invoice changes.
5. Cancelling and refunds
You can cancel on the web at any time. Cancelling stops the next renewal; the plan stays active until the end of the period you have paid for.
- Individual plans — you can ask for a full refund within 14 days of your first purchase of a paid plan, with no reason needed. After those 14 days we do not refund the current period, but you can cancel at any time and the plan stays active until the end of the period you have paid for. This does not limit the guarantees you have under the Australian Consumer Law, which cannot be excluded; if one applies to you, you may be entitled to a remedy, including a refund.
- Teams plans — if you leave an annual plan or seat part-way through the term, the unused whole calendar months after the month of your request will be refunded, never part months. Monthly plans will not be refunded. This does not limit the guarantees you have under the Australian Consumer Law.
6. Your records and your tax obligations
You remain responsible for your tax records, for what you claim and for what you lodge. Kestly shows what you recorded and what our calculations show; reports and estimates are aids, not tax advice, and we do not say that any trip, claim or invoice meets an ATO requirement. Check anything important with a registered tax agent.
Export your data when you need a copy. We keep your data while your paid plan runs. After a paid plan lapses we keep it for up to 3 months, and remind you several times to export it before it is removed from your account. The ATO expects you to keep most business records for 5 years (ATO record keeping rules, checked 31 Oct 2026); that duty is yours, not ours, and you can export your data at any time.
7. AI features
Receipt reading and the language assistant use AI services. They make mistakes. Always check what the AI read or drafted before you save it; what you save is your record. Receipt reading only starts after you allow it, and each plan has a monthly limit. The Privacy Policy says what is sent and to whom.
8. Location and your phone
Trip recording depends on your phone: its permissions, battery settings, signal and the rules of the phone's operating system. A trip may be missed, cut short or recorded wrongly. Look over each trip, set whether it is business or private, and add its purpose. You are responsible for the entries in your logbook.
9. Teams
A Teams plan lets a business add staff who record trips under one team. The team Owner pays for the plan and chooses who joins. What the Owner and Admins can see of a member's trips is described in the Privacy Policy.
10. Third-party services
The service relies on other providers, listed in the Privacy Policy. Your use of Apple Maps, Google Maps or your phone's address lookup is also subject to those providers' terms. We are not responsible for the availability or policies of other providers.
11. Acceptable use
You agree not to use Kestly to:
- break any law or regulation;
- infringe the intellectual property rights of others;
- distribute malware or other harmful code;
- disrupt or interfere with the service;
- harass, abuse or harm other users.
12. Your data and our content
The Kestly name, logo and content belong to us and are protected by intellectual property laws. You may not use our trademarks without written permission. What you record in Kestly belongs to you, and you let us process it to provide the service as the Privacy Policy describes.
13. Closing your account
You can delete your account at any time, on the web at /account (both apps also have it in Settings). It is scheduled for deletion in 30 days and you can restore it by signing in during that time. Export your data first. How deleting your account works lists what is deleted and what may stay for a short time.
We may suspend or close an account that breaks these terms. Where we reasonably can, we will email you first, say what the problem is and give you time to fix it. We may suspend or close an account straight away if the breach is serious, if it puts the security of the service or other people at risk, or if the law requires it. If we suspend or close your account, you can ask us for a copy of your data at hello@kestly.com.au, and we will send it unless the law or a court order stops us.
14. Warranties and liability
Some guarantees under the Australian Consumer Law cannot be excluded. Nothing in these terms limits those guarantees, or any other right or remedy you have under a law that cannot be excluded, including mandatory consumer rights in the country where you live.
Kestly is a record-keeping aid. We take care to provide it, but we do not promise that it will be error-free or uninterrupted, or that it will meet every need you have.
To the extent the law allows, we are not liable for indirect or consequential loss arising from your use of the service, such as loss of profit, business opportunities or revenue. We are also not liable for loss that comes from a tax or other decision you make using our reports and estimates, because they are aids and not tax advice (see section 6). If any part of this section is not allowed by law, it does not apply to you, and the rest of these terms still apply.
15. Changes to these terms
We may change these terms. We will post the new version at https://kestly.com.au and change its date. If you keep using Kestly after a change, you accept the new terms.
16. Governing law
These terms are governed by the law of the Australian Capital Territory, Australia. Each of us submits to the non-exclusive jurisdiction of the courts of the Australian Capital Territory and the federal courts that sit there. Nothing in this clause removes any right you have under the Australian Consumer Law, or any mandatory consumer right in the country where you live, that cannot be excluded by contract.
